Legal Question in Real Estate Law in Texas
Sewer problems from faulty work by previous owner
1 year after purchase of house we started having problems with the septic system. For 3 years we have tried several ways to correct. It has finally been discovered that while the pool was being installed in the backyard the feild lines for the grease trap were relocted around it. Then a concrete slab for the pool deck was poured over the grease trap. The only way to correct this is a $7,000 relocation of the entire septic system. The previous/original owner denies all knowledge of making this error, along with the installer of the pool. There was no mention of it at disclosure. Do I have any recourse from the previous owner, does he have any legal responsibilities for the pronblem?

Re: Sewer problems from faulty work by previous owner
Unless you can prove that your seller knew of the defect and deliberately concealed it from you, you are out of luck.
The warranty period having run, the repairs will be on you absent the fraud mentioned.
