Legal Question in Real Estate Law in Texas
Shared/boundary fence, installed by developer in subdivision.
The neighbor and us both agree the boundary fence need repair; however, they insist on replacing the whole fence, and want us to pay half the cost. But we only want to repair the broken portions, while sharing the cost.
Is there a law that would resolve this difference?
What would the law dictate, if they went ahead to have contractor replacing the whole fence, and require us to pay half?

You don't have to share have the cost. If they replace, then they have ownership of the fence. If you share the cost, you share the ownership.
