Legal Question in Real Estate Law in Texas
Shoddy Home Repair and Remodeling
I hired someone to do remodel damage from flood/mold.I have paid him $20k.He thinks the ins.co. owes him another $45k but his has tons of duplication&errors, actual amount owed is more like $18k. Of which $5k are upgrades I would be responsible for,the other $13k is what he hopes the insurance company will on add'l work done w/o approval. The total ins.est. of both claims flood/mold=$45k.More importantly since ''completion'' of house,he has had to come back(4)times-faulty electrical work, once for a serious gas leak,(2) times-painting touchups (still not done satisfactorily),(2)times-air conditioning problems(I found the work billed for was never done)and today I found a serious water leak under the bathroom cabinets/tub.Now i have mold on downstairs ceiling. We now have rats/roaches as he let the refuse build up in an area between our house&garage and his workers tossed food remains&other garbarge onto it.Same done in house for days until I complained. My brand new front lawn is wrecked because the workers washed out paint brushes w/paint thinner, now lawn has a lot of dead spots.

What is your question? Where this is probably heading is the contractor putting a lien on the house and your litigating it in court. You may have a fraud claim however better to negotiate as litigation is expensive $10,000 to $20,000. Larry Maun 713.266.2560
