Legal Question in Real Estate Law in Texas

Signing of deed.

I am in the process of selling an undivided interest in a piece of land in Texas.

I live in Colorado. They sent the Deed for me to sign and Notarize. No Check or Draft was included therewith. They told me to sign the Deed and they will send me a Check for the agreed amount. Is this correct? Should I have received a Check or a Draft with the deed?

Is this transaction closing through a title company? If not, that's a red flag and I would not deliver the deed without cash in hand. If there is a title company involved, you can deliver the deed in escrow to the TC -- but ask to see a closing statement showing how much money you are getting first.

Mr. McDermott is definitely correct. You don't want to sign the deed until you are assured of receiving proper payment. You can contact us for counseling if you wish.
