Legal Question in Real Estate Law in Texas

Silverleaf Timeshares Transfer Process

I have purchased a timeshare deed from Silverleaf through a third-party vendor that includes bonus time (additional nights over and above the deeded week). The issue I am having is the resort is refusing to honor the previous owners endless escapes feature that is no longer offered that has significant perks. They are saying since I am not a family member (which if I was I could receive the endless escapes) I must sign a notarized statement agreeing to the new bonus time provisions that are not equal to what was offered in the original deed. It would appear to me they can only change what I am eligible for IF I sign which is why it must be notarized. However they are telling me they will not give me any bonus time if I dont agree. I was told there was a suit that addressed this issue and went to the trouble to pulling the documents. The suit does address what they will do in the future, however my question continues to be if they can actually force me to agree to different stipulations than what was in the original deed if I do not want to? Isnt a deed a deed and they must honor that original deed?

Re: Silverleaf Timeshares Transfer Process

An attorney would need to review all of the paperwork signed in this deal to determine whether you this "endless escapes" bonus was part of the contract.

If, in fact, the resort either misrepresented the bonus structure or they are simply refusing to honor some aspect of the contract by giving you false information about the contract, you may be able to sue under the Texas Deceptive Trade Practices Act.
