Legal Question in Real Estate Law in Texas
sister claims land as her own
I found property and put a deposit down and signed a contract. I moved onto the property with my older sister. She told me she would make payments for me so I could get caught up on some bills; I said ok. I moved away a year later because we weren't getting along. I asked her to move out and she did not, so I was forced to leave. I could not live under such tension; plus she was taking it out on my daughter. She stayed there and has been making payments on the property. I had told her I planned to move back. I have always considered her payments as rent for being there. When I told her I was preparing to move back, she informed me the property was now hers and that I needed to sign it over to her- put in her name. She has told everyone the land is hers and she will sell it, but I never said I would give or sell it to her. Can she take it away like she said she can? Can I just move a mobile home on the property without telling her anything? How do I get her to move off of the property, since she is claiming it is hers? What do I do?

No. She can't take it away like that. You need to contact an attorney to file a partition lawsuit against her so you can get your fair share out of the property.
