Legal Question in Real Estate Law in Texas
We sold our house "for sale by owner" in December 2009. The new owners made 2 payments. The husband left and wife has signed a Warranty Deed but we cannot locate the husband to sign the Warranty Deed. What legal options do we have to regain our property.

If the property was sold under a deed of trust, then you will have to foreclose to regain your property.

From your question, you may have sold under different circumstances than a traditional sale. It could be that the best thing is to talk to the purchasers and have them deed the property back to you if that is the case. I would need to look at the papers prepared for your closing to advise you properly.
