Legal Question in Real Estate Law in Texas

My son took an IPOD touch to his friends and it got stolen. The kids mom said the only one who could have taken it was one of her other children and asked us to please not press charges. She said she was expecting a check from her employer in May and would replace it. I have emails from her saying this also. Now she is saying it was her sons friend that stole it but she would still replace it but we have to wait because she has her own bills to pay. Would I be able to take her to small claims court and/or have a chance to win? Since we made an agreement now the police dept. will not let me press charges. They said it is now a civil matter.

The police are lying. They can prosecute anybody they want to. They just don't want to do the work.

File a lawsuit in small claims court; the filing fee will be about $100.
