Special Warranty Deed

My grandparents made a special warranty deed giving me one percent of their property. My grandmother recently passed away. She left everything to my grandfather. He wants me to sign a legal document giving my 1% back to him so the will can go through probate. If I refuse to sign it, he says the will can not go throught probate. Is this true? Is there any way I could loose the 1%? If my grandfather dies, and leaves his 99% to someone else what could happen to my 1%?

It is not necessary that you convey your 1% to your grandfather. If he sells the other 99% you still own an undivided 1% of the property. L. Maun 713.266.2560
