Legal Question in Real Estate Law in Texas

We stopped payment on a check to a carpet cleaner who did a really bad job. He left soap every where, even after saying that all he used was steam. We had the money in the bank and had to have another company neutralize and remove the soap he left. He has filed with the Hot Check division. What recourse can we take?

Defend yourselves against the criminal charges (if in fact the prosecutor follows up), and sue the guy in civil court for breach of contract.
