Legal Question in Real Estate Law in Texas

Survey Costs

We are currently in the process of selling a home; the bank/title company is requesting a survey. Is it the responsibility of the buyer or the seller to pay for the survey?

Re: Survey Costs

The contract to sell the real estate -- you do have written contract, don't you? -- typically provides for a survey and who pays for it. Absent such a provision, neither party is obligated as a matter of contract to provide one. However, if the buyer's lender won't make the loan without a survey, as a practical matter one must be done. If the buyer won't pay for it, you must decide whether you will lose the sale over this item. Should be less than $500. Maybe you can offer to split he cost.
