Legal Question in Real Estate Law in Texas

taxes

If an individual holds a mortgage on a property for someone and the mortgagee is constantly late therefore making the escrow payments for insurance and taxes late. The holder of the mortgage wants to foreclose, but the person living in the house wants to sue because his taxes payment was short. What are the rights of both parties?
