Legal Question in Real Estate Law in Texas
Tennant Eviction
Do I have the civil to regain my rental property by means of cleaning out said property of all personal effects of renters. Property was abandoned six weeks prior to today. Husband is removing his voluntarily, the wife left all of hers and has not been back in six weeks. It is her effects that I question. Can I legally remove her posessions with fear of legal action. All I want is to have them out of the house, so that I may take back posession of the home, not keep her from retreiving her things. Can you help me?

Re: Tennant Eviction
Yes, you may remove her effects to safe keeping while you rennovate and prepare to rent the premises again. It is your legal obligation to mitigate your damages, so renting again is the best way to do this.
You must make reasonable efforts to locate the woman whose possessions you have removed. Inquiring of her husband or family and friends is the place to start. If you get her address send her a certified letter telling her her possessions are in storage and she must redeem them by paying the storage charges and, if she does not within the time specified, they will be sold at auction to satisfy the storage bill.
The exact procedure, should you be require to do this, must be gotten from a local lawyer familiar with the storage lien laws and landlord-tenant laws of your state.
