Legal Question in Real Estate Law in Texas

Texas Counties with Open Range Laws

I am interested in finding out if Pecos County should have legal documents pertaining to ''Open Range''. And if they are an Open Range County? Do you know? And where would one find out ?

Texas doesn't have open range. I think Montana does or used to. Try there.

If you are referring to the "fence in" versus "fence out" distinction, you should call the Pecos County Clerk and inquire. Sometime in the past, the Commissioner's Court of each Texas county made a resolution as to whether their county would be open range (which is I believe "fence out") or not. If the person you are speaking to doesn't know, ask to speak to the County Clerk him- or herself, and they will know what you are referring to and be able to point you in the right direction.

Alternatively, any personal injury attorney who practices in that county is likely to know, since the answer to this question usually bears on liability when an accident occurs involving livestock.
