Legal Question in Real Estate Law in Texas

Timeshare issue

We have a timeshare with Silverleaf resorts. Unfortunetly due to pay cut and hour loss we could no longer afford it in our budget. We tried to work witht them but they were not very easy to work with so we began to ignore their calls. Finally my husband said we cannot afford to pay you anymore please just foreclose on the vacation deed. They were rude and mad and said they would proceed. It is now a few months later and I recieved a letter from them saying we have 10days to pay them seven grand or be sued. We obviously cannot still afford to pay them but a few months back I spoke with a man from Silverleaf who told me technically they cannot sue us in the state of Texas but if we lived in Illonoise they could. I am very confused on if they can sue us and what will happen to us if they do sue us. I am very scared and do not want to be sued I would rather just have to live with the fact that it will be on our credit report for seven years. My question is .. can they sue us in Texas and what will happen after they do sue us. Thank you very much!

Re: Timeshare issue

Any one can sue you and the venue would be TX since it is your residence. What they will end up with is an uncollectable judgment against you if you can't afford to pay. It will reflect negagively on your credit and will eventually drop off after 10 years if they don't renew the judgment (usually they don't renew).
