title company won't close on our home transaction
My mother and I live together in Katy,TX Harris county. She wants to leave and buy herself a smaller home so I am buying her current home from her. The bank has already approved my loan. The title company will not close on this home because they say she can still live here and claim homestead. They want proof that she will buy another property to claim homestead on. In order for her to buy another home, she needs proof of funds which would be proceeds from the home she is selling to me. How does what the title company make sense? My mother moved out into a rental on a month to month contract until she has the proceeds to buy her new home. She indeed wants to show them that she will not live with us. Title company refuses to close. I don't understand. What can I do?

First, have whomever is representing you in this transaction contact the title company and ask them specifically what they want for proof. Ask if they will accept an affidavit from your mother as to her intent. If they won't cooperate, ask another title company to close.
