Legal Question in Real Estate Law in Texas

Do title companys have to honor abstract of judgments when the property has a homestead exemption. We are selling our property and the Tile co is going to take the amounts of the abstract of judgment out of the money we are to get. Can they do this?

They can do it, but you can opt to change the title company to one who can work within the statute. There is a procedure for removing the a.j. which should be taken prior to closing.
