Legal Question in Real Estate Law in Texas

Trashed House Next Door

We live next door to a woman who has abandoned her house and left it full of filth and garbage. (six years of garbage strewn throughout the house!) We cannot get anyone to do anything about this. The Homeowners Association said it is up to the mortgage company, and the mortgage company is in another state, and is doing nothing. The place is infested with mice and maggots, and this is a beautiful subdivision where everyone keeps their yards and houses in great condition. We have contacted the Health Dept. and they say they can't do anything until the mortgage company allows them. We are at our wit's end living next door to the stench. We have run out of options and need your advice.

Re: Trashed House Next Door

You need to find out who owns the house. Sue them for a private nuisance.

Your HOA can take action, as the house condition is likely violative of HOA rules. Also, if the house has been abandoned, there are likely back HOA fees. The HOA can foreclose to collect them.
