Sexual Harassment

Does caving in to your employer who has repeatedly made sexual advances toward you constitute consent that would bar a sexual harassment lawsuit against the employer ?

Re: Sexual Harassment

No, not necessarily so. It all will depend on the specific facts, what your modus operandi was, what he/she did to you to pressure you, and your reasons for "giving in" to the advances. You need to consult with an attorney to discuss the facts more completely.

Re: Sexual Harassment

I am not a Texas attorney. However, generally as long as you show that your motivation was because of the employer's job related pressure you can still have a good case. But if you consented because of non-employment related reasons (you were in love, or it was otherwise consensual) your case will not be very strong.

Talk to a local attorney with experience in these matters.
