Legal Question in Sexual Harassment in Texas

How far does a supervisor have to go before being liable

My wifes supervisor has made several sexually explicte comments to her such as "we can take that out in trade" and off color jokes. My wife is not a prude or eaisly offended and choose to let the comments slide rather than make a scene. This comment really offended me because he wanted to make sure she did not tell me. We need her to work right now but she has left thier employ due to the mistrust we have of them. She is working somewhere else now. Is there something that should be done about this supervisor or should I just be glad she is no longer thier?

It seems that you may have a constructive discharge claim. She should go to the EEOC office or the Texas Commision on Human Rights and file a claim. While the facts are soe what thin this may be a good case. I would be happy to discuss it with you. Please feel free to email or call me at 512 392 5010.
