Legal Question in Traffic Law in Texas
Auto accident....at fault party changed statement after claim.
My wife was hit in the rear by a driver. At the time of the accident, the driver accepted responsibility and at the request of my wife to either call the police to the scene or the at fault party call and give a statement to their insurance co.; the driver called and gave a statement where she accepted responsibility. My wife was given the claim no. Later that evening, my wife got a call from the insurance co stating that the claim was being investigated as the driver now stated that she was hit in the rear so she hit my wife in the rear and that she was not at fault.
Now this was not a 3 car accident and that driver did not do anything to make it seem as it was at the time. She also accepted responsibiltiy giving a statement to her insurance co.
Now her insurance company is telling us to file with our company for uninsured motorist accident who fled scene. This is however not the case. Can my wife do anything to go after the at fault party who hit her in the rear.

I strongly recommend that your wife put this statement of events in writing NOW while it is fresh in her mind. She should send a copy to your insurance agent, after notifying them of the fraud that is being perpetrated.
