Legal Question in Traffic Law in Texas
My bf received a letter in the mail, im guessing from DOT, saying that they caught him in Texas twice driving without a license. I know that it was not him because we were living in WA at the time. We think that someone used his information and now they think it was him. We currently live in NC and he has not tried for a license yet because of this situation. We don't know what to do because we were told by a friend that they would still take him to jail or make him pay for the tickets ($800). I really don't want to take a trip to Texas to try to handle this and then he gets locked up when we are there. Please help! What do we do to resolve this problem without him being locked up or ticketed for something that was impossible for him to do?

If the letters give offense dates, gather evidence that you not in Texas. a great example would be a time record at work. Or if he was in jail in Washinton. cops love paper. Since it takes a while to travel to Texas see if you can find something showing he was in Washington at or near the time of the offense. Send a copy to DPS. Send another copy to the district attorneys of each county where the offense is supposed to have occurred.
If he has not been arrested, found guilty and sentenced, the cases can still be dismissed.
Another option is to hire an attorney that practices in the counties where this took place and have him deal with the DAs. They would be happy to get the case off their books.
