car accident - insurance won't pay

A valet backed into me & dentd the hood of my car. I got a police report and cld the numbr the valet gave me. I spoke with the office manager, she told me to get two estimates, I did and faxd the info back to them. The office mngr asked me to pick either body shop b/c the estimates were so close, I did, which was the smaller of the two. In the process, I decidd not to get the hood fixed b/c I am able to open the hood. I told the Office Mngr that I was not going to have my hood repaired, I wanted a cash settlement instead, she was upset by this, I could tell in the tone of her voice, she told me ''We don't do that, that'll have to be approved by the owner''. He was out, I called bk, spoke to the owner, he stated '' So, you don't want to get your car repaired''. I explaind to him why. He said he wasnt going to pay the estimate price to me b/c my car is old and the estimate price is the same as what my car is worth, he said he would pay half. I explained to him, ''I did what you all told me to do - we went back and forth and he told me I could see attorney about it if I wanted to. I said ok, I will. He also would not give me the name of his ins. co. I calld my ins co and I'm letting them handle it. What do you think the outcome will be?

I am thinking that if you do not have a lien on your car, you should pay a lawyer $100 to send a demand letter and resolve the problem, and keep your insurance out of it. Your insurance premium increase will more than offset the cost.
