Legal Question in Traffic Law in Texas
Claim denied-Insurance says must go by their insured statement
I'm driving straight in a parking lot...lady comes flying & turns into me(from the left) smashing both doors on my driver's side. Private property-police does not make a stmnt. Both myself & my passenger give our stmnts to her insurance agency. Her insurance estimates that my car is totaled. After waiting about two weeks, her insurance calls to tell me that they must take their insured stmnt( that I swerved into her lane, trying to avoid a speed bump)over mines. Didn't I have the right of way in this accident?

Re: Claim denied-Insurance says must go by their insured statement
Your question deals with civil issues and is not a criminal issue. You need to hire a civil attorney, and go after the other guy's insurance company. Or you need to let your insurance fix your vehicle and let them go after the other guy's insurance company.
