Help! Daughter drove car without insurance

I have a car that is in my name that I got for my daugher about two years ago. She was driving a couple of days ago and was broadsided by another woman, but she received the ticket for failure to yeild the right of way. Both her passenger and the other lady were hurt and she has no insurance. I have an agreement that was done two years ago that said she was responsible for the note and that she was required to keep insurance on the car, but I just found out today that she had none. I am legally responsible for the injuries to the people and to the damage to the other car if I wasn't driving and she had no permission to drive it without insurance? Is there anything that I can do to protect myself? Evidently the bank knew that there was no insurance because I just recieved a notice in the mail that they had taken out a policy that protected their investment. Thanks for any help and direction that you can give.

You are right to find out what your liabilities as soon as possible.

You say that the other woman broadsided your daughter, but that your daughter failed to yield the right of way. If the other woman contributed to the accident, it may be possible to lessen the damages. The failure to maintain insurance is a legal issue that should affect only your daughter. If she gets a citation, then her license can be affected. It's important know if that citation comes later. Additionally, if a judgment is rendered against one or both of you for damages in an uninsured accident it will affect your licenses.

Retain a PI lawyer to determine what your range of liability looks like, and try to reach a settlement with the woman, with a payout schedule. Make your daughter share in the cost. Might be much less costly in the long run to address this head-on.
