Legal Question in Traffic Law in Texas
dettained
I was recently stopped on a traffic violation. I was Handcuffed and placed in the back of the police car for over 20 min, due to someone else, as stated by the police officer, with my First initial and my last name having a warrant in Utah. I was under the impression that If I was being detained that I was to be read my rights and place in custody

Re: dettained
Police are allowed a temporary onsite detention. Am assuming you were released when it was determined you were not the same person as named on the warrant. In that case, there was no charge against you, and so nothing to suppress. Whether or not they read you your rights then becomes moot.
