Failure to yield on left turn

My daughter was in a car accident yesterday. She was turning left on a residential street and another car coming from the other direction was turning left also. They both had their blinkers on, stopped and then turned left. Another car passed the car across from my daughter and broadsided my daughter's car. This was a 2 lane residential street and that car was illegally passing on the right. Our problem is that the other car that turned left (not involved in the collision) left the scene of the accident. The police officer ticketed our daughter for failure to yield when making a left turn. We would like to fight the ticket and not have this accident go on our daughters record. Do you think we have a chance? The only other witness to the accident was our daughter's boyfriend, who was a passanger in her car.

Hard to say. If the street was a two lane residential street, then the right lane was a traveling lane, and proving that the car was illegally passing on the right is an uphill battle. If the car was not speeding, and was visible, then the person making the left turn still has to yield. Bottom line, you have an argument, but it will be very difficult to prove and difficult to prevail.
