Legal Question in Traffic Law in Texas

How to fight an erroneous tollway violation?

I received an invoice for three tollway violations on the North Dallas Tollway in July. I do not drive on the tollway and have never driven in Plano, where the violations occurred. No one else has access to or borrows my car, including service personel in the last month. I can produce witnesses for at least one of the occasions that my car was at home in the garage at the time of the supposed violation.

There were no photographic images available with the ticket.

I contacted the tollway authority and they offer no resolution process. Either I pay the fine or they first send my account to a collection agency then to DPS for adjudication.

First, can I stop the collection process, which I assume will hit my credit rating?

Second, what is the best procedure for getting this dropped or winning in court?

Any other considerations?

Thanks,

The tickets should have given you a contact or hearing number for the JP office that is handling the tickets. You can dispute the tickets -- normally they are handled by the JP in Carrollton. Let me know if you need additional information.
