Legal Question in Traffic Law in Texas

hit & run

At 5am, my neighbor's car was hit hard as it sat parked by the curb, a hit & run. There's substantial damage to the back left rear, however, they're apprehensive about calling the police because of lack of insurance. I don't think they have anything to worry about as this isn't the ''main'' car used (hubby in Iraq), therefore insurance & tags have expired. I think police need to be called because the other car may have insurance to cover the damage. Neighbor is afraid other insurance would refuse to pay & threaten legal action instead. Who's right? We have a very short window here! Thanks so much!

I would recommend that they report the incident to the police. Insurance is a non-issue since it was parked. They might get cited for the tags, but I doubt it. The hit-and-run driver may have caused other damage in the neighborhood, and may have been identified.
