Legal Question in Traffic Law in Texas
Lawsuit
In Texas is it legal to sue someone who 'supposibly' caused a car accident at the age of 17 if his mother was in the car with him at the time? He is now 19. Can the other party sue him for the accident? Or is his mother legally responsible because her name was both on the insurance and car title and she was in the car with him at the time also?

In general, a child can be held liable for his torts. The collectability of a favorable judgement, however, is another question altogether. But, if the car was insured at the time I would pursue a claim against the insurance policy. With any luck the kid was not an exluded driver.
