occupational driver's license

Does a judge have the authority to deny an occupational driver's license to someone who has been convicted of 6 or more DWIs or is every person entitled to an occupational license?

It is my understanding of the caselaw and the provisions of the Texas Transportation Code, that if a properly filed verified petition, which proves essential need, is filed; that the court is obligated to issue the occupational license. The court does have great leeway in imposing restrictions on the occupational license.
