Legal Question in Traffic Law in Texas

no posted speed limit

i was ticketed for 42 in a 30 but the city street on which i was traveling has no posted speed limit in the direction that i was traveling, i entered this street from a u.s. hwy. and had only traveled approx. 2/10's of a mile when i was stopped. there is no posted speed limit until crossing a signaled intersection approx. 1 1/2 mile away. i know the speed not being posted is in error because the traffic flow in opposite direction has two signs in the 1 1/2 mile distance. is this enough defense to get the citation dismissed?

Re: no posted speed limit

It depends. You could argue that before the judge and see if he agreed with you or not. You could also go to court to see if the police officer showed up. Usually, however, you are presumed to know the speed limit where you are traveling even if you don't. That's one use of the term: "speed trap".
