Legal Question in Traffic Law in Texas

Pressing further charges for car accident

Is it possible to ask that further charges be pressed against a person at fault for a car accident? I was involved in a car accident about a month ago with a 17 yr old who had no insurance. There were injuries with this car accident and since I have uninsured motorist and PIP coverage I don't think I can just have a lawsuit against him. There were 5100 in damages to my car, I think I've sustained back injuries since the accident and my passenger has knee injuries and an injury to his right hand which both caused about a week's worth of loss of time at work. I've checked out his myspace and he shows no remorse nor any changes to his driving habits. ''damn i've been wanting this for a long time 4 tickets and one crash aint gonna stop me ahahaha fuck ya'' is just one of many comments he's made to friends with public profiles on myspace. He was going 52 in a 35, has been stopped by officers 8 times and has been cited 4 times besides the failure to control speed for the car accident. He was not cited for not having insurance, I found that out the hard way when trying to make a claim. Plus the kid races and is putting turbo in his car. Is there a way to have his DL suspended and how would I go about pressing further charges?

Re: Pressing further charges for car accident

You need to sue him for the damages. In Texas, failure to satisfy a monetary judgement for an at-fault accident can result in a driver's license suspension. The TxDot website has additional information on the suspension.
