Seatbelt Laws in Texas

My husband and I recently moved to Texas from California. We still have CA plates and driver's licenses but are in the process of having out car registered in Texas.

My husband was returning from a physical therapy appointment. Because some of the work done at this appointment that had caused his shoulder to be sore, he pulled his seatbelt shoulder strap lower (under his arm) to make himself more comfortable. He was wearing his seatbelt properly until then. While he was sitting at a stop light, a policeman pulled up behind him and gave him a ticket for a seatbelt violation. Can that be done? Can a ticket be issued to an adult for wearing his seatbelt ''wrong''?

The "Safety belts" statute is located at Sec. 545.413 Tex. Trans. Code.

It does not state that you must wear it in any particular manner but does state that you must be secured by it.

There is an exception for medical reasons but it must be in writing from a licensed physician and presented to the court not later than ten days from the date of the alleged offense.
