Legal Question in Traffic Law in Texas
small claims court
My new car was totaled by an uninsured motorist. Can I sue the party in small claims court? If so, should I sue the mother (owner of the vechicle) or the son (driver) or both ?

Yes you can -- but if they can't afford insurance, probably can't afford to pay the judgement. Sue the owner and the driver.
