Legal Question in Traffic Law in Texas
Speeding Ticket
My husband was issued a speeding ticket but insists he was not speeding and wants to fight this in court. How do we go about this? He says he was going 62 in a 60MPH zone but the State trooper said he was going 77.

Re: Speeding Ticket
This is actually a common complaint about speeding tickets. Often the defendant acknowledges speeding, but disagrees with the amount of mph over the limit. As your husband is doing. Under the law it is not relevant as to the offense. Speeding by 2 mph is the same offense as speeding by 17 mph. He will lose the case. He might consider making his plea to the ADA in order to pay the correct fine, rather than the inflated fine. He would rather have deferred or defensive driving than a conviction and a fine.
