Legal Question in Traffic Law in Texas
Spouses past due Traffic Fines
If my husband had an accident in 2005/2006 and I was told he pleaded guilty and was given time to pay out his fine, but now he's in a nursing home with Dementia/Alzheimer, what happens to his fines? Can I be sued for them as his wife? Can they come after me and arrest me for the past due amounts? Can he be arrested from te nursing home for the past due amounts? I'm receiving final warnings in the mail on the matter and I know I'm his wife, but it's not my offense. What should I do?

Re: Spouses past due Traffic Fines
First, you will not be arrested. Secondly, who has legal control of his money? Who is paying his bills for the nursing home, and from what funds? That person (you?) needs to contact the court and explain the situation. If it is not resolved, then contact an attorney to assist you.
