Legal Question in Traffic Law in Texas
In Texas if I receive a "notice" and not a summons or supeona to appear in court do I have to go? It would be as a witness for someone who is fighting a traffic citation.
1 Answer from Attorneys
Think of it this way: In Houston, you have tons of accidents where there ARE witnesses but no one stops to give their information. Some people could take advantage of the situation and use their strong compelling personas to convince everyone they are right. Without you helping them find out what the truth is, it is nothing more than a yelling match. No one really knows what happened, you are a critical component in this hearing. More than you know.
Yes, the court sent you a notice and didn't subpeona but if you were the one in court would you want your witness to show up?
Now, don't let anyone push you around. You saw what you saw and if any of the attorneys like or hate what you have to say - so what - you are the one testifying.
They often like to cut people off -- ask the Judge can you finish your answer without being cutoff or interrupted. They will or should say YES! Why? Because the jury needs to hear the whole story and not just a soundbite.
