Legal Question in Traffic Law in Texas

Uninsured Motorist

My wife was recently involved in an accident in which the other driver failed to yield when turning left. The result was about $900 damage to our 2003 vehicle. The other driver was cited for the accident and for being uninsured. We do not plan to submit a claim to our insurance company, since our deductible is $500 and we previously declined uninsured motorist coverage. My wife called the phone number the other driver gave and found it to be a friend's number. She asked that the woman call immediately so they could make an arrangement for payment. The other driver hasn't called back. Obviously, she has no intention of paying. What are our options to collect? My wife was in a similar situation years ago and was notified that she had to send payments for damage or her license would be suspended. Can we initiate something similar?

Re: Uninsured Motorist

As long as there was at least $1000.00 worth of property damage or injury to any party to the accident you can attempt to get restitution under the Safety Responsiblity Act.
