Legal Question in Traffic Law in Texas
violation of rights?
I was recently stopped for a burnt out tail light. As I was talking to the officer, a wrecker showed up. The officer ran my name and said I had two warrants. He asked me to step out of the vehicle. He gave me the ''follow my pen'' test. As this was happening, the wrecker was hooking up to my car. After his pen test, the officer gave me two options. Either go with him to jail or ride with the wrecker to my house. I chose home. The officer immediately left, giving me no citation or warning, or my license. After the 4 mile drive, the wrecker said I needed to give him $100. I only had $70, and he declined. He then asked me to sign his log stating he was there, I did, and he left with my car after giving me his card. I called the number the next day and the fee was now $297. The officer never charged me and my car is impounded. What can you do to help?

You may go the law enforcement agency where the officer works and file a complaint with the Department. Since I do not know who the agency is, I cannot tell you whether or not that is a wise idea. You may also go into small claims court and file a small claims case against the officer, although I do not what you signed so I do not know who authorized the towing of the car.
