If there are 2 heirs who pays the debts

My mother passed away in the fall before she had a chance to sign her will over to exclude one of 2 daughters. . so. When there are 2 heirs (according to the state), who pays for the debts of the dead? If there is a life ins policy to only one of the two, would the debt fall on to the one with the policy or would it still be split? What if one of the 2 doesn't or refuses to pay? Would they still be entitled to their 1/2?

Call a local lawyer if there are any assets. Life Insurance policies are not part of an estate..and normally is used to pay for the funeral..Debts are paid out of the estate..not by individual heirs..hence, call a lawyer
