Legal Question in Wills and Trusts in Texas

2 wills /2 deaths

My aunt dies in Oct. 2003, she left 100% of a pention fund to my grandmother, my grandmother then dies in April of 2005. No other person was named on my aunts will to receive the pention fund. Does this go to my grandmother estate? and the benficary of my grandmothers estate get it or who? Does it matter when my aunts will was put in probate?

The pension fund became part of your grandmother's estate. If she left a will, it would go the the named beneficaries. If no will, it would go to her heirs at law.

A will must be probated within four years of the date of death if administration is required. However, pension funds, insurance, etc. passes by contract to the named beneficiaries and is outside the will or probate estate.
