Legal Question in Wills and Trusts in Texas

Affidavit of heirship

My maternal aunt, who died in 2001, has some unclaimed property (insurance-related) that is being held by the State of Texas. Her husband passed away later the same year. They had no children. Her siblings and his siblings are all deceased.

I believe that I am the rightful claimaint to this property. The State of Texas has asked that an Affidavit of Heirship be filed with thte county clerk. What is that document? And how do I go about filing one? I used to live in Texas, but now live in Washington State.

Thank you.

Re: Affidavit of heirship

An Affidavit of Heirship is a document setting forth the marital history and geneology of the deceased showing the bloodlines to the heirs at law. It has to be signed, under oath, by at least two disinterested people with knowledge of the stated facts.
