Affidavit of Heirship

Regarding my parent's property, you told me I could get an affidavit of heirship for my dad's part which he left everything to my mother who never had his will probated. Is this something I would do at the county courthouse like probate court or is it a much simpler process and less costly? Would I have to go to court?

Probate is a legal process involving courthouse and judges. If you don't know how to do it, see a lawyer. It might not be as expensive as you think. shop around. WalMart is cheaper than Nieman Marcus.

When did everyone die (dates)? Were there debts of the estate? Was there any other property besides the house? There are simple and inexpensive processes, but they are fact specific. I don't have enough information to tell you what you need to do.
