My brother moved in with his out of state girlfriend and a year later he passed away. The police called it a suicide, but yet he was trying to move out of her house that very weekend and had all of his things packed and ready to leave before we got the call from her. She ended up badmouthing my family online, and after my parents drove all the way there to get his items they were promised, they were sent back home with only a few of his clothes and told they were not allowed to take anything else until we sent his now ex girlfriend some of his ashes. As it turns out, she started dating another guy only a month later and engaged within 5 months. She has said several times that she is going to send all of his items but doesn't want to pay, so I told her I would pay all the expenses to get them here, to which she never replied. I would like to know what legal action we can take since they were not ever married for my parents to get his belongings back and what type of lawyer we would need to speak to.

The executor or administrator of your brother's estate could get an order from the probate court ordering the girlfriend to turnover the assets for distribution. You need a probate attorney.
