There are a few ways. The most common is to get letters testamentary issued by a court. This gives you legal authority to act on behalf of a deceased person's estate. These are issued pursuant to a will. (If there is no will, then it would be letters of administration.) In smaller cases, you can draft an affidavit for a judge to review and sign, provided that there are less than $50k in estate assets, solvent estate, etc.
