changing the name on land & home to surviving spouse

My father-in-law recently passed away, leaving a will naming his wife as sole beneficiary. Their land and home, where she currently resides, is in his name only. How does she change it to her name and what responsibility does she have to creditors (credit card companies) to pay bills on accounts that are in his name only?

Probating the will will take care of title to the house. The executor might consider filing an executor's deed from the estate to the beneficiary. As to the debts, there is no quick and simple answer. It would have to be analyzed.

The solution to your problem: The will must be probated as a muniment of title. I have done this over one hundred times in 18 years of practice in Houston. I can get this accomplished quickly. Call me at 713-785-5595.
