Legal Question in Wills and Trusts in Texas

My common-law husband died in June without a will. He has an adult son by a previous marriage. The Dept of Veteran's Affairs recognizes us as married. His son has agreed to let me keep our property & vehicles. Do I still need probate court? How long can I wait (I'm broke!) Thanks

You have 4 years after a death to have an estate administered. Any party interested in an estate can apply to have it administered. This includes heirs and creditors.
