Legal Question in Wills and Trusts in Texas

Contest Will?

Myself and three brothers were willed my step-mothers estate. One of the four brothers was named executor. He has communicated that he plans to place all monies, after debt, in an account in his name rather than distributing equally as the will states. Isn't it his responsibility as executor to see that the requests of the will are met and if he does not comply is the only other alternative to contest?

Re: Contest Will?

You don't contest the will, you go after the executor!

Re: Contest Will?

As executor, he is required by law to pay all of the bills, probate the will, and distribute the proceeds. If he fails to do that you should contact an attorney ASAP to represent your interests and preserve your share.
