my dad died and had no will his wife My stepmom claims that everything is hers. I have one sister and he has 1 brother. Is she right? I was told half goes to me and my sister

THe answer depends on what property is there, who bought it, etc. Stepmom keeps what she brought into the marriage, and her 1/2 of the community property. Aside from that, the children have a share. HOWEVER, your rights are not self-enforcing. You need to get counsel--NOW if you want to protect your rights. There's very little you can do 'after the fact'
